Dr M Buwule Kasasa who has been battling cases with the family of the late Sir Edward Muteesa has again defeated them in court of Appeal.
The case is civil appeal no. 152 of 2o2o and civil application no. 213 of 2020. The justices of the court of appeal made their ruling last week and dismissed an appeal lodged to the court by the family of the late Muteesa II.
Dr Kasasa was represented in court by Lawyer Simon Kiiza. Dr Kasasa is the registered land lord of land in Mutungo which he bought as 3rd buyer after Muteesa sold it while in distress and exiled abroad.
Muteesa’s family who could not be reached for comment have reportedly threatened to appeal to a higher court against this weeks judgment.
Details about Mutungo land
The land in dispute is approximately 640 acres and once belonged to the late King of Buganda Sir Edward Mutesa II but he sold it in the late 1960’s and the same land was later sold to Dr. Kasasa in 1978 by Barclays Bank when its owner failed to service a bank loan. The property had been mortgaged in the bank specifically under what is termed as equitable mortgage. This statement above is supported by information that is available in government offices one them, at the Ministry of Land in Uganda Kampala.
Muteesa’s children have on several occasions failed to tell various courts in Uganda that the land belongs to them and have persistently disputed to the fact that Dr. Kasasa owns the Mutungo land.
Someone who has closely monitored this case was asking whether Mengo will survive Dr. Kasasa court cases. “Will Mengo survive Dr Kasasa two cases? he asked.
