Is Mengo in crisis over property disputes yet they are not needy?
The Court of Appeal in Uganda has heard a case in which a Businessman and his family are tussling it out with the family of the late King Sir Edward Mutesa II over a house in Buzinga in Kampala.
Dr. Kasasa’s family stormed court some many years ago protesting what it called grabbing of their house by Prince David Wasajja. The Buziga house or property is worth Billions of shillings.
The house once was occupied by the two former Presidents of the DR Congo, Laurent and Joseph Kabila. When they stayed in Uganda before they were made Presidents.
The Mengo side then secured an illegal court distress order to evict from the house Dr Kasasa’s relatives. To cut this whole story short, the house was later given by Mengo to Prince David Wasaja who was as well a member of the Buganda Land board.
The Court this week Presided over by Justices Ceboleon, Madrama and Irene Mulyangonja after a tough court session in which Counsel Simon Kiiza Represented Dr. Kasasa’s family said it will give its verdict by notice soon.
The Same family of Dr Kasasa is again wrestling with Prince David Wasajja group over Mutungo Land which has been contested in court by the two parties for close to 20 years now.
The Justices in the same court but a different team of Justices in the Court of Appeal would also soon be giving their verdict on the same matter by notice. The court session in this matter was held some weeks ago.
Dr, Kasasa relatives insists that Mutungo land, the disputed property belongs to him and that he acquired it legally in the 1970’s when he bought as 3rd buyer land that Mutesa II sold when he was reported to be broke and in distress while in exile in London.
Dr Kasasa says that he bought the suit land from the Bank when those who mortgaged it could not service a Bank loan which they had secured from Baclays Bank, according court records.
What puzzles Dr Kasasa’s family is that over the years, Wassaja’s side has failed to prove in court by adducing tangible evidence that Dr Kasasa grabbed their family estate but nevertheless are pursuing the matter hoping to overturn Dr. Kasasa status as the landlord a registered proprietor of the suit land who maintains that he his a bonafide purchaser.
